Claude security for businesses and law firms

Claude is widely used for long-document analysis, writing, research, and coding — work that often involves the most sensitive documents an organization has. The security questions are the same as for any AI assistant: whose account, what data, what connections, and what it is allowed to do.

What Claude is and how organizations use it

Claude is Anthropic's family of AI models and the Claude apps built on them. Organizations encounter Claude as individual consumer plans, as administered Team and Enterprise workspaces, through the Anthropic API (directly or inside other vendors' products), and through Claude Code, Anthropic's agentic coding tool, which is covered on its own page.

Its long context window makes it popular for reviewing contracts, discovery documents, policies, and research — which is exactly why law firms, healthcare organizations, and financial firms need clear rules for it.

Verify current terms

Vendor plans, features, and contractual terms change often. Treat the descriptions on this page as a starting point and confirm the current terms, admin settings, and data-handling commitments for your specific plan directly with the vendor before relying on them.

What Claude can access

  • Uploaded documents and pasted text, including large files processed in full.
  • Projects that hold shared documents and instructions reused across conversations; anything placed in a project is available to everyone with access to it.
  • Connectors and integrations, including Model Context Protocol (MCP) servers, that let Claude search or act in other systems such as drives, email, calendars, ticketing, or code repositories with the authorizing user's permissions.
  • Web search and research features that bring untrusted external content into the conversation.
  • API access from your own or vendors' applications, where the application — not the user — decides what data is sent.

Key Claude security risks

Consumer versus commercial terms

Anthropic distinguishes between consumer plans and commercial offerings (Team, Enterprise, and the API). Consumer terms include individual-level settings that affect how chats may be used, while commercial terms govern organizational use. Employees using personal plans for client or patient work place that data under terms your organization did not negotiate and cannot administer.

Confidential documents at scale

Because Claude handles long documents well, users upload entire contracts, case files, or data exports rather than excerpts. The volume of sensitive data per interaction is higher than with short-context tools.

Connectors and MCP servers

MCP makes it easy to connect Claude to internal tools. Each server is effectively a new integration with its own authentication and permissions. Community-built servers vary in quality, and a server that can write, send, or delete gives the model those abilities. Treat MCP servers as third-party software requiring review.

Prompt injection

Documents, emails, and web pages can contain instructions aimed at the model. The risk is highest when a single session combines untrusted content, sensitive data, and the ability to act (send email, write files, call APIs).

Is Claude safe for law firms?

Law firms can use AI assistants responsibly, but professional obligations add requirements beyond general security. Bar guidance in many jurisdictions emphasizes competence with the technology, protecting client confidences, supervising the output, and in some circumstances informing clients about AI use.

  • Use only firm-administered commercial workspaces for client matters — never personal accounts.
  • Confirm the vendor's commercial terms on training use, retention, and confidentiality, and record them.
  • Decide whether client consent or engagement-letter language is required for your practice and jurisdiction.
  • Keep privileged material out of shared projects that are broader than the matter team.
  • Require attorney review of all AI-assisted work product; never file or send AI output unreviewed.
  • Restrict connectors to document-management and email systems until ethical walls and matter-level permissions are verified.

Our law firm generative AI governance guide covers this in depth, and our legal industry page explains how FlashTower supports firms.

Claude and HIPAA

No AI tool is "HIPAA compliant" on its own. HIPAA obligations attach to how a covered entity or business associate uses a service: whether a Business Associate Agreement (BAA) is in place that covers the specific product and plan, how the service is configured (retention, sharing, access controls, audit logging), and whether workforce use stays within what the BAA and your policies permit.

Confirm with Anthropic whether a BAA is available for the specific offering you intend to use, and limit PHI to accounts covered by it. FlashTower treats PHI access by a vendor-hosted system without a recorded BAA as a Critical finding.

Recommended controls

  1. Standardize on an administered Team or Enterprise workspace with SSO and MFA.
  2. Document the commercial terms that apply — training, retention, and data location — in your vendor register.
  3. Maintain an allow-list of approved connectors and MCP servers, with an owner and review date for each.
  4. Separate agents or sessions that browse untrusted content from those with sensitive data or write access.
  5. Set project-sharing norms: projects scoped to the smallest necessary group.
  6. Train users on what may not be uploaded, and on verifying output before use.
  7. Record Claude in your AI inventory with owner, purpose, data classes, and capabilities.

How FlashTower assesses this

When you add Claude to a FlashTower Scan, the Risk Engine evaluates how it is actually used in your organization — account type, data accessed, capabilities, autonomy, credentials, logging, and vendor terms — against a versioned, deterministic ruleset. These rules are the most relevant for Claude. Each fires only when its stated condition is met. See how scoring works.

Sensitive Data

  • FT-DAT-010Critical

AI system accesses health information without a BAA

The AI system accesses PHI, is vendor-hosted, and no Business Associate Agreement is in place.

  • FT-DAT-011Critical

Frequently asked questions

Is Claude safe for law firms?

It can be, when used through a firm-administered commercial workspace with documented terms on training and retention, restricted connectors, matter-appropriate sharing, and mandatory attorney review of output. Personal accounts should never be used for client matters. Check your jurisdiction's professional-responsibility guidance on AI.

Does Anthropic train on business data sent to Claude?

Anthropic distinguishes consumer plans from commercial offerings such as Team, Enterprise, and the API, which are governed by commercial terms. Read the current terms for the plan you use and record the commitment that applies.

Is Claude HIPAA compliant?

No AI service is HIPAA compliant on its own. Confirm whether a BAA is available and covers your specific use, configure the service accordingly, and keep PHI out of any account not covered.

Are MCP servers a security risk?

They can be. Each MCP server is an integration with its own permissions. Review servers like any third-party software: who maintains it, what it can read and write, how it authenticates, and whether it can take irreversible actions.
